Terms of Service

01 Acceptance of Terms

These Terms of Service ("Terms") are a legal agreement between you and Bidwell Health LLC, a Florida limited liability company ("Bidwell Health," "we," "us," or "our"). By accessing or using the Bidwell Health platform ("Service"), you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service. Your continued use of the Service constitutes acceptance of any updates or modifications to these Terms.

02 Services Description

Bidwell Health is an asynchronous telehealth platform that connects patients with licensed healthcare providers for the evaluation and treatment of specific, non-emergency conditions, including but not limited to:

  • Urinary tract infections (UTIs)
  • Yeast infections
  • Erectile dysfunction (ED)

The Service is not designed or intended for medical emergencies, urgent care, or conditions requiring in-person examination. Bidwell Health does not operate an emergency medical service.

03 Eligibility

To use the Service, you must meet all of the following requirements:

  • Be between 18 and 64 years of age.
  • Be physically located in a state where Bidwell Health's providers are licensed to practice at the time of your visit.

Currently licensed states: Arizona (AZ), Colorado (CO), Connecticut (CT), Florida (FL), Iowa (IA), Maryland (MD), Montana (MT), New Mexico (NM), New York (NY), Utah (UT), Virginia (VA), and Washington (WA).

If you do not meet these eligibility requirements, you may not use the Service. Providing false information about your age or location may result in termination of your account and forfeiture of any fees paid.

04 Not Emergency Care

Bidwell Health is not a substitute for emergency medical services. If you are experiencing a medical emergency, including but not limited to chest pain, difficulty breathing, severe allergic reactions, suicidal thoughts, or any condition you believe may be life-threatening, call 911 immediately or go to your nearest emergency room.

The Service is designed for non-urgent, routine conditions only. Bidwell Health and its providers are not responsible for any adverse outcomes resulting from the use of this platform for conditions outside its intended scope.

05 Patient Responsibilities

By using the Service, you agree to:

  • Provide accurate, complete, and truthful information on all intake forms, including your medical history, current medications, allergies, and symptoms.
  • Follow up with in-person medical care if directed to do so by your provider.
  • Not use the Service if your symptoms worsen or if you develop new, concerning symptoms before your case is reviewed.
  • Keep your account credentials secure and not share access with others.
  • Use the Service only for your own personal healthcare needs.

Failure to provide accurate information may compromise the quality of care you receive and could result in harm for which Bidwell Health bears no liability.

06 Fees & Payment

Bidwell Health charges a flat fee of $45 per visit. This fee covers the provider's review of your intake form, clinical assessment, and any prescriptions issued if deemed appropriate.

  • Payment is collected at the time of submission via Stripe, our secure, PCI-compliant payment processor.
  • Fees are non-refundable once a licensed provider has begun reviewing your case.
  • Bidwell Health does not currently accept insurance. You may submit your receipt to your insurance provider for possible reimbursement at your discretion.

We reserve the right to modify our pricing with reasonable notice. Any price changes will not affect visits already submitted.

07 Provider Relationship

Healthcare providers on the Bidwell Health platform are independent, licensed medical professionals. They are not employees, agents, or representatives of Bidwell Health. The provider-patient relationship is established directly between you and the treating provider.

Bidwell Health serves as a technology platform that facilitates the connection between patients and providers. All clinical decisions, including whether to prescribe medication, are made solely at the provider's professional discretion.

08 Prescriptions

If your provider determines that a prescription is clinically appropriate, it will be sent electronically to the pharmacy of your choice as indicated during your intake.

  • Prescriptions are issued at the sole discretion of the reviewing provider. A consultation does not guarantee a prescription.
  • Medication costs are separate from the Bidwell Health visit fee and are your responsibility.
  • You are responsible for picking up your prescription and following all dosage instructions provided by your provider and pharmacist.

09 Limitation of Liability

To the fullest extent permitted by applicable law, Bidwell Health, its officers, directors, employees, affiliates, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or health outcomes, arising out of or in connection with your use of the Service.

Bidwell Health's total aggregate liability for any claims arising from your use of the Service shall not exceed the amount you paid for the specific visit giving rise to the claim. The Service is provided "as is" and "as available" without warranties of any kind, either express or implied.

10 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes arising from or related to these Terms or the Service shall be resolved exclusively in the state or federal courts located in the State of Florida.

11 Changes to Terms

Bidwell Health reserves the right to update or modify these Terms at any time. We will notify users of material changes by posting the revised Terms on this page with an updated "Last updated" date. Your continued use of the Service after such changes constitutes your acceptance of the revised Terms.

We encourage you to review these Terms periodically to stay informed of any updates.
